RTI: CIC Pulls up MCD Delhi

   The Central Information Commission has pulled up the Municipal Corporation of Delhi for not giving information to an applicant under the Right to Information Act.

   Chief Information Commissioner Wajahat Habibullah in his decision observed that the public information officer (PIO) appears to have denied information with malafide intention and that he also did not comply with the orders of the first appellate authority despite the passage of a whole year. In the decision, the CIO said, “However, since it is the responsibility of the first appellate authority to ensure that the orders passed by it are duly complied with by the PIO, the commission, therefore, has decided to remand the case back to the first appellate authority Raj Mohan Singh, additional commissioner (HQ), to ensure that his orders under section 19(1) are duly com plied with by issue of certified copies as sought and holding of site inspection in terms of the order so passed, with the qualification that now, in accordance with Section 7(6) of the RTI Act, 2005, no fees will be charged for any further information provided.”

   In this case, one G.B. Singh had submitted a series of applications to the DC, MCD, Shahdara (south zone), concerning alleged violation of high court orders and lay out plans for Mausam Vihar and Sukh Vihar colonies in Delhi. In all these cases responses had been received.

   However, not satisfied with these responses appellant, Mr Singh moved appeals before additional commissioner (HQ), who is also the first appellate authority Mr Raj Mohan Singh. In his order, the first appellate authority, Mr Singh directed as follows: “The public information officer is directed to provide the desired information to the appellant and settle the issue after inspection of site in question and personal hearing to the appellant.”

   On a representation on non-compliance submitted to him, Mr Raj Mohan Singh issued further orders directing that a compliance report be submitted to him within five days from the date of issue of his notice.
